
Status Changes
You may be eligible to change/extend your status, if you are a nonimmigrant seeking to extend your stay, change to another nonimmigrant category, or reinstate your F-1 student status after a status violation. This applies to visitors (B-1/B-2), students (F-1), dependents of visa holders (e.g., H-4, L-2), and others in eligible categories. It allows you to maintain lawful status or regain it through reinstatement while remaining in the U.S. during processing. It is crucial to file before your current status expires to avoid being considered out of status.
F-1 Reinstatement
F-1 reinstatement is a process for students who have violated their F-1 status, allowing them to regain lawful status without leaving the U.S. Common reasons for status violations include falling below the required full course of study, failing to extend an I-20 before it expires, or unauthorized employment. To qualify for F-1 reinstatement, you must not have been out of status for more than 5 months (unless exceptional circumstances apply), intend to resume a full course of study, and have not engaged in unauthorized employment. The status violation must not have resulted from willful or fraudulent actions. Reinstatement allows you to continue your studies and maintain a lawful presence without leaving the U.S. Applications must include a reinstatement request letter, a new I-20 endorsed by your DSO, proof of financial support, and evidence supporting your case.
